1. Seller and scope
PressFlow is supplied by Fell & Harbour. In these terms, “we”, “us” and “our” refer to that seller.
Email: contact@press-flow.co.uk
Geographical business address: 79 Towncroft, Dearham, Maryport, Cumbria, CA15 7HY
These terms cover our website, purchases of PressFlow software and the official activation, update-download and standard-support entitlements supplied with a purchase. A separate written scope applies to a commissioned website build, hosting or bespoke development project.
PressFlow is designed for print businesses, but consumers may purchase it. You are a consumer when acting wholly or mainly outside your trade, business, craft or profession. Buying through a website aimed at printers does not itself remove consumer rights.
Nothing here excludes rights or obligations that applicable law does not allow us to exclude.
2. What you are buying
PressFlow is a self-hosted WordPress/WooCommerce plugin. Your order identifies the plan, price, permitted official site activations, entitlement period and any separately agreed services. All features included in the purchased PressFlow edition are included in that plan; there are no compulsory PressFlow feature-module purchases.
You provide the compatible hosting and underlying WordPress/WooCommerce installation unless a separate service agreement says otherwise. Domain names, hosting, payment-processing charges and optional third-party products are separate costs. A PressFlow licence does not require you to buy hosting from us.
Product descriptions and specifically agreed pre-contract statements form part of your purchase. A general marketing example is not a promise of a particular level of sales, profit or production throughput. We will supply the functionality and services actually described for your order.
3. Orders, payment and delivery
You must have legal capacity to make the purchase and authority to act if ordering for a business. Give accurate billing and contact information, review the order and correct any errors before payment.
The checkout identifies the price, currency, applicable tax and total payable before you confirm the purchase. Any currency conversion or overseas card charge imposed by your bank is determined by that bank. We do not add undisclosed PressFlow transaction fees.
Your order is accepted when we confirm acceptance and make the purchased download or entitlement available following payment. An initial automated receipt alone does not require us to accept an order we cannot fulfil. If we cannot accept it, we will explain and refund any payment taken. We will not substitute a higher price without your agreement.
Software is delivered digitally through the download method described at purchase. After a paid order is processed, the product key is supplied in the customer order information or customer email. Delivery can be delayed by payment review or technical failure; contact us if the promised access has not arrived.
We will provide a confirmation that you can retain, containing your purchase details and the relevant contractual and cancellation information. Keep your invoice and product key secure.
4. Annual entitlement
Annual plan
Unless the order states a different period, an annual entitlement runs for 12 calendar months from the recorded paid date. It includes the official site activations stated in your order, access to released update downloads and standard support during that period.
Annual purchases under these terms are renewed manually. We do not automatically charge another year. You can request renewal through contact@press-flow.co.uk. The renewal price and period will be stated before you choose to renew. Changes to future prices do not change an already-paid period.
Expiry ends the paid official-service entitlement; it does not remove the open-source permissions described in section 5. An older installed version may continue to work, but future platform changes or security needs can make continuing without updates unsuitable. Our current plugin does not delete print jobs or orders merely because a commercial entitlement expires.
5. Open-source software and official services
The PressFlow plugin is distributed under GNU General Public License version 2 or later (GPL-2.0-or-later), as identified in the plugin. That licence governs your rights to use, study, copy, modify and redistribute the covered code. These commercial terms do not impose additional restrictions on those GPL rights. Applicable third-party licence notices also apply to their respective components.
Your purchase pays for the supplied software distribution and associated official activation, update-download and support services. The number of paid site activations is a limit on those official services, not a restriction overriding the GPL's permission to run the code. A redistributed copy does not automatically include another purchaser's official service entitlement.
Do not share product keys or activation credentials, sell access to another person's customer account or impersonate an entitled purchaser. This restriction concerns access to our services, rather than a ban on redistributing GPL-covered code.
The GPL does not grant a right to present your modified product as an official PressFlow release or imply our endorsement. Respect third-party copyright, attribution and trademark rights. You may truthfully identify your use of PressFlow.
You can customise the plugin and use its hooks. We can reasonably ask you to reproduce an issue on an unmodified supported release to identify its cause. Our own product obligations and consumer rights are not automatically cancelled merely because you made a modification.
6. Activations and moving sites
Official activations are associated with a site address and installation identifier. A staging or development installation uses an activation unless your order expressly includes an exception. Release an activation before moving it to another site; contact us if the old installation is inaccessible.
Activation and subsequent checks contact the PressFlow licence service over HTTPS. Our privacy policy explains the limited installation information sent. Licence checks do not send print customers, orders or artwork to us. WordPress cron and a working outbound connection are required for scheduled checks.
If a service outage prevents a legitimate activation or move, we will investigate and provide reasonable assistance. A key's technical status does not override an entitlement you can demonstrate was purchased and remains valid.
7. Compatibility, setup and use
Review the published system requirements before purchase and keep the supported WordPress, WooCommerce, PHP and PressFlow versions current. Hosting limits, custom themes, builders and unrelated plugins can affect behaviour. We do not promise compatibility with every third-party combination, but we remain responsible for the compatibility and functionality expressly described or specifically agreed for your purchase.
You control your print prices, quantities, materials, finishing, production estimates, tax settings, discounts, shipping and payment methods. Review demo data before publishing products and test a complete purchase. A configuration supplied as an example does not establish your production costs or an independently verified tax treatment.
You remain responsible for fulfilling your print customers' contracts, checking artwork and proofs, protecting their information, honouring their rights and complying with your business's applicable laws. Automated file checks and previews assist your review; they do not guarantee colour accuracy, suitability of every file, print quality or delivery by a particular date.
Testing before live use
Before accepting live orders, you must configure and test PressFlow on a separate staging or development site: a private copy of your website. Test your product options, prices, tax settings, discounts, checkout, payment methods and artwork workflow, including a complete test order.
Example products and configurations are starting points. You are responsible for checking that your selling prices, production options and customer information are correct before making them available to customers.
Keep current backups that you can restore. Repeat relevant tests before deploying updates or significant configuration changes. Avoid using real customer information or live payment details in development tests unless necessary and appropriately protected.
Failure to take these precautions may affect responsibility for losses to the extent that the failure caused or increased the loss. It does not automatically remove your refund rights or any statutory rights, or excuse a failure by us to meet an obligation the law does not allow us to exclude.
Do not use our website or official services for unlawful content, infringement, abusive communications, unauthorised access, malicious uploads or attacks. Do not submit private customer information to a public demonstration. Our demonstration is for evaluation; test jobs shown there are not accepted orders for physical printing unless expressly offered as such.
8. Standard support and updates
Standard support is included during an active annual entitlement as defined in section 4. It covers installation guidance, documented setup, configuration questions and investigating reproducible problems in supported PressFlow functionality.
Contact contact@press-flow.co.uk. Support is normally handled Monday-Friday, UK time, excluding public holidays. We aim to make a first substantive response within two working days; this is a service target, not a guaranteed resolution time or 24-hour emergency agreement.
Bespoke coding, extensive product/catalogue data entry, running your print business, website redesign, hosting administration and fixing unrelated third-party products are outside standard support unless specifically included in your purchase. We will agree any charge for optional additional work before starting it.
We may request relevant versions, redacted diagnostics and steps to reproduce an issue. Access to your installation requires your separate permission. We do not need unrestricted permanent administrator access as a condition of ordinary support.
Updates are supplied as released downloads through the stated delivery channel. Automatic in-dashboard update delivery is not included unless specifically stated for your order. Where applicable law requires updates or remedies, those obligations are preserved.
9. Refunds and consumer cancellation
Our voluntary licence refund policy
For a new licence purchase or paid annual renewal made directly from us, you can request a full refund within 30 calendar days of payment, without needing to demonstrate a fault. Email us with enough information to locate the order. We refund the amount paid for the affected licence, including applicable tax, without deducting our payment-processing fee, through the original payment method unless another method is agreed.
We process these refunds without undue delay and normally within 14 days of your request. Refunding the licence ends the associated paid activation, update-download and support entitlements. It does not require you to give up GPL rights in a copy lawfully received. A separately priced service or build is not automatically covered by this voluntary software policy.
Statutory rights
Consumers may have a statutory cooling-off right, normally 14 days after a distance contract is made. For immediate digital-content supply, that right is lost only where the legally required prior express consent, acknowledgement and confirmation have been provided and supply has begun. Agreeing to general terms alone is not that consent.
Where services start at your express request during a cancellation period, any lawful charge on cancellation must reflect the service actually supplied and the required information. A service cancellation right is lost on full performance only when the legal conditions are satisfied. Those rules must not be treated as identical to downloading software.
If we have not met the conditions that law requires, we will not rely on the immediate-supply exception. Failure to provide required cancellation information can extend a statutory cancellation period. Our 30-day policy does not shorten any longer statutory right.
Consumers retain the right to digital content that meets applicable quality, fitness and description requirements, and to services supplied with reasonable care and skill. Depending on the circumstances, remedies can include correction, repair, price reduction or refund. Legal remedies for qualifying damage to a device or other digital content also remain available. We do not apply a blanket “no refunds on downloads” rule.
To cancel, send a clear statement to our email or business address. You may use the online cancellation form and email instructions, but it is not compulsory. Submit your statement before the applicable deadline. Where a statutory refund is due, we make it within the legally required period and by the required method.
10. Website builds and bespoke work
A full website build or other bespoke service, including work offered under the Fell & Harbour brand, requires a written proposal identifying the actual legal supplier, scope, deliverables, prices, payment stages, timetable, acceptance arrangements and any ongoing services. This page does not make an unidentified third party responsible for that work.
The proposal must state which licences and maintenance are included and the ownership/licensing of bespoke deliverables and third-party assets. Extra work needs an agreed scope and price. Hosting or maintenance is not included simply because you bought PressFlow.
Cancellation and payment for work already performed follow the agreed lawful project terms and any applicable consumer rights. A project is not made non-refundable merely because it involves custom software. Access to shop customer data must be covered by appropriate written instructions and data-processing arrangements.
11. Service restrictions and termination
We may suspend an official service where reasonably necessary to protect it from a security threat, investigate compromised credentials or address a material breach of these terms. We will explain the reason and, where appropriate, give a reasonable opportunity to correct the issue. Urgent protective action may be needed before notice.
We will not revoke a paid entitlement merely because you make a fair complaint, request a lawful refund, modify GPL code or decide not to buy hosting from us. Suspected fraud or credential abuse will be reviewed on the available evidence.
If we permanently end a paid service without a breach by you, we will provide any refund or other remedy required by law and consider the unused paid entitlement. These provisions do not override paid commitments or authorise erasing your shop's orders and artwork.
12. Responsibility and liability
We do not exclude or limit liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or statutory remedy that cannot lawfully be excluded or limited. Nothing in these terms restricts a regulator's powers or a person's non-excludable data-protection rights.
For consumers: we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for a loss that is not foreseeable. Your statutory digital-content, service and damage remedies remain available. The business-only limitations below do not apply to your consumer purchase.
For business purchases only: subject to the exclusions that cannot lawfully be made and to applicable reasonableness requirements, our aggregate liability arising out of or in connection with an affected PressFlow licence purchase or renewal, whether in contract, tort (including negligence), misrepresentation or otherwise, is limited to the total licence fees you paid for that purchase or renewal. This is an aggregate limit for the affected purchase or renewal, not a separate limit for each claim. An agreed refund remains payable and is not counted against this limit.
Subject to the same protections and applicable reasonableness requirements, for business purchases we are not liable for loss of profit, revenue, anticipated savings or business opportunity, whether direct or indirect, or for indirect or consequential loss. These exclusions do not apply to a consumer purchase and do not reduce the GPL rights themselves. Liability for separately contracted website builds or bespoke services is governed by the applicable project contract and mandatory law.
You must take reasonable steps to limit a loss when you become aware of a problem. We are not responsible to the extent that a loss is caused by your incorrect configuration, unauthorised changes, use outside the documented supported requirements, or failure to carry out the testing and backup precautions in section 7. These provisions do not excuse a defect or breach attributable to us, prevent an agreed refund, or restrict any liability or remedy that cannot lawfully be excluded or limited.
We do not treat an obligation under our paid supply contract as removed merely because the GPL contains a software warranty disclaimer. Each liability provision applies only to the extent permitted by applicable law.
If an event beyond our reasonable control delays a service, we will notify you and take reasonable steps to reduce its effect. This does not let us keep payment indefinitely for an undelivered service or override applicable cancellation or refund rights.
13. Complaints and disputes
Email contact@press-flow.co.uk with your order details and the outcome you seek. We aim to acknowledge ordinary commercial complaints within five working days and provide an explanation or progress update within 14 calendar days. Privacy complaints follow the separate process in our privacy policy.
You can use any court, regulator or dispute-resolution route available to you by law. We do not require private arbitration or waive a consumer's right to bring a claim. If we cannot resolve a consumer complaint, we will provide any information about alternative dispute resolution that the applicable law requires, including whether we will participate.
These terms are governed by the law of England and Wales, subject to mandatory protections that apply to a consumer in their country of habitual residence. Consumers may bring proceedings in the courts available under those protections; UK consumers resident in Scotland or Northern Ireland are not required to give up their available local courts. For business disputes, the courts of England and Wales have exclusive jurisdiction unless a mandatory law provides otherwise.
14. Changes and general terms
The terms supplied with your accepted order apply to that purchase. We can publish revised terms for future purchases, but do not impose a new support charge, shorten a paid period or remove promised benefits retrospectively. A material change to an existing contract needs a lawful basis and appropriate notice or agreement.
If a clause is unenforceable, the remaining lawful terms continue to apply. Our failure to enforce a clause immediately does not remove the right to enforce it later. Your statutory rights remain unaffected.
We may transfer our business or contractual obligations only in a way that does not reduce your existing contractual and statutory protection, and will notify you where appropriate. You may transfer your rights where law permits; contact us to arrange the corresponding paid activation/account records. The GPL separately governs transfers of covered software.
Our privacy policy explains personal-data processing. Acceptance of these terms is not consent to marketing or a waiver of data-protection rights.
